Depreciation - New Effective Lives Released
The Buzz Is OUT NOW!

The Income Tax (Effective Life of Depreciating Assets) Amendment Determination 2017 (No 1) was registered on Monday.

It applies from 1 July 2017 and provides taxpayers in specific industries and for specific assets with effective lives as a basis to calculate the depreciation of an asset for income tax purposes.

Under the Uniform Capital Allowances (UCA) system, taxpayers can either use an effective life determined by the ATO, or self-assess their own effective life of an asset. Effective lives determined by the ATO provide a "safe harbour" for taxpayers, in the sense that these rates will be accepted by the ATO.

Penalty Rates Cut
The Buzz Is OUT NOW!

For those of you who handle client payroll, in a historic ruling the Fair Work Commission has
announced this morning that Sunday and public holiday penalty rates paid to retail, hospitality
and fast-food workers will be cut.

Full-time and part-time hospitality workers will have their Sunday penalty rate cut from175% to 150%

Full-time and part-time retail workers will have their Sunday penalty rate cut from200% to 150%

Full-time and part-time fast food workers will have their rate cut from150% to 125%.

Public holiday rate in retail, hospitality, and fast food will also be cut.

The cuts to public holiday rates will start from July 2017,

The commission will take further submissions as to the commencement date of the Sunday
rate cuts.

With the public holiday rate cuts to commence from July, those of you that handle payroll should ensure you observe the changes to the rates from this time. We will inform you of the commencement date of the Sunday rate cuts when it is finalised.

GST and Ride-Sharing - Uber's Court Appeal Dismissed
The Buzz Is OUT NOW!

The Federal Court today dismissed an appeal by Uber, and ruled that ride-sharing is a “taxi service” for GST purposes. This confirms the ATO’s long-held position, and means that ride-sharing drivers must register for GST as soon as they commence working (rather than when their turnover reaches $75 000).

A Win For BAS Agents
TPB turns around on its Cloud Accounting Position

In what is seen as a turnaround on their original Cloud Accounting position (which we described at the time as BAS Agent/Tax Agent unfriendly), a fresh Exposure Draft / Practice Note has just been released by the Tax Practitioners Board (TPB). Gone are the objectionable aspects:

  • A huge responsibility shift to Agents
  • An inefficient process of assessment of Cloud providers by Agents
  • A time pit of red tape placed on Agents
  • A risk to PI insurance cover.

Additionally, Australian Bookkeepers Association worked directly with the Board to clarify and modify the wording around the general factors that BAS Agents may wish to consider when entering into cloud computing arrangements.

Australian Bookkeepers Association (ABA) is pleased with the substantive changes that have been made which alter the tone of the document from instructional to informational, and we thank the Board for making the changes.

We also thank the hundreds and hundreds of BAS Agents who gave us their views about the original Exposure Draft and the adverse effect it would have had on their business if unamended. We took all of your views forward and they were heard.  

The Details of the Change

As you may recall, the Tax Practitioners Board late last year released for comment an Exposure Draft Information Sheet Cloud Computing and the Code of Professional Conduct. The Australian Bookkeepers Association made clear in our written submission to the Board earlier this year, the Exposure Draft was decidedly ’BAS Agent-unfriendly’ in that it  shifted the responsibility for client Cloud security to BAS Agents. By bracketing the choice to use Cloud accounting with any other outsource choice that a bookkeeper may make (like a subcontractor), the Board potentially made it a Code of Conduct violation by the BAS Agent for client information security breaches that may occur as a result of security failures by Cloud providers. Before we filed our submission with the Board, we sought your feedback which was overwhelming supportive of our view – urging that the Board soften its position, and remove this onus from BAS Agents. This feedback from our members was then collated and attached to our submission.
 
The good news is our voices have been heard! Following public consultation (including taking on board our submission and your feedback), the Board has now just released its revised  Practice Note which addresses the concerns raised in our submission as follows:

  • It largely removes the onus on Agents to assess the security credentials/practices of Cloud providers – something for which Agents are not qualified to do, and would likely not do anyway. The amended Paragraph 7 of the Practice Note has been ‘watered down’ and now only stipulates that an Agent ‘may’ wish to consider various IT security factors ( 10 factors are listed at Paragraph 7) before using a Cloud provider. The original version of the Exposure Draft used the word ‘must’, while a later version used the word ‘should’. The watering down of this requirement transforms this aspect of the Exposure Draft from instructional (i.e. you ‘must’ or you ‘should’ consider the various listed factors) to informational (i.e. you now ‘may wish to’ consider the various listed factors…there is now no compulsion) – thus relieving Agents of a responsibility for which many are not qualified to undertake.

 

  • The removal of the requirement by Agents to conduct a rigorous assessment of a Cloud provider’s security practices (by reference to the 10 factors listed at paragraph 7), saves Agents significant time and hassle. There is now no strict requirement to get answers to these questions from Cloud providers, and then (assuming the answers can even be obtained) weigh these various factors before using a Cloud provider.

 

  • In relieving this onus on Agents, the revised Exposure Draft removes what may otherwise have been a PI insurance risk for BAS Agents. If the Exposure Draft had proceeded in its original form, it could have had adverse insurance outcomes in the sense that when a statutory authority like the Board prescribe a wide interpretation on a professional conduct issue (as had been done in the original Exposure Draft) then this could expose gaps in cover in existing policies. This risked an Agent’s cover in the event of a claim and potentially may have left some Agents exposed.  

 

  • The inefficient process involved in some 70 000 registered Agents across Australia seeking answers to and information from a limited number of Cloud providers on their IT security practices has now been largely eliminated. No longer ‘must’ Agents consider and get answers from Cloud providers to the various factors listed at paragraph 7 as part of their obligations under the Code of Conduct.

 
Action Plan for BAS Agents as a Result of the Amended Exposure Draft?

With the bookkeeper-unfriendly provisions gone, where does the amended Exposure Draft leave bookkeepers in terms of their Code of Conduct obligations vis-a-vis the use of Cloud Accounting?
 
Code Item 6 of the Code of Conduct says that Agents are still required to disclose to clients that they are using a Cloud provider and obtain client consent before putting a client’s information ‘in the Cloud’. Why? By way of background, Code Item 6 states:
 
     “unless you have a legal duty to do so, you must not disclose any information relating to a client’s affairs to a third party without your client’s permission.”
 
In terms of the method of disclosure, the Exposure Draft at paragraph 12 stipulates that the Client Engagement Letter is an appropriate medium. To this end, in terms of wording, you may wish to review your Engagement Letter for adequacy or adopt the clause contained in our Client Engagement Letter Template which is available on our website. For those of you who do not use Engagement Letters (and, for a whole range of reasons, we strongly recommend that you start doing so) alternatively disclosure will need to be made by some other (preferably written) means e.g. email (and be sure to obtain a record of client acknowledgement).    
 
Where to from here with the Exposure Draft?

Together, with our submission and your feedback, we’ve contributed to achieving some major  ‘BAS Agent -friendly’ changes to the Exposure Draft – changes which it must be said were largely not sought and fought for by all industry associations. However in our view there are still a number of minor aspects of the latest Exposure Draft that could have clarification/improvement for bookkeepers before the Board finalises its position later this year on how the Code of Conduct applies to Cloud computing. We will take these matters up with the Board in our final submission on the latest Exposure Draft over the next few weeks.

Updated Tax Tables Are Now Here!

Minimum Wage Increased!
The Buzz is out!

An expert panel of the Fair Work Commission yesterday handed down its annual minimum wage order. It increased the minimum wage by 2.4% to $672.70 per week, or $17.70 per hour (up from $656.90 or $17.29).

This will impact more than 1.86 million Australian workers (employees not covered by an enterprise agreement or a modern award). For those of you who handle client payroll, the order will take effect in relation to a particular employee from the start of the employee's first full pay period on or after 1 July 2016.

Lodgement Extensions: Portal Issues
Lodgement Extension due to portal issues

With the ATO Portal down yesterday, lodgement deadlines for quarterly BAS have now been extended from 26 May to 30 May as per the following message from the ATO Facebook page:

Tax professionals: We apologise for the inconvenience caused by today's portal outages. We understand the impact this has on you with lodgments falling due.

Once our portals are back online, you can complete your lodgment work by Monday 30 May 2016 without the need for a deferral request, and we won't apply any penalties.

Should you require more time past 30 May 2016 to complete your lodgments, please lodge a deferral request. We're actively working on a fix and will post an update when our systems are back online.

Lodging Deferral Requests During Peak Lodgement Periods

During peak lodgment periods, the ATO may take up to 28 days to process deferral requests.

The ATO has advised not to resend a further deferral application for the same clients within the 28 day processing period. Doing so could cause possible delays to the processing of your original request.

Simpler BAS for Small Business
The Buzz is out!

For the many of you who handle client BAS, the ATO has announced that, following consultations (including with your Australian Bookkeepers Association), several GST labels will be removed from the BAS, with small businesses only required to report:

  • GST on sales (1A)
  • GST on purchases (1B)
  • Total sales (G1).

User testing starts from 1 July 2016 and stakeholders will be kept informed of the results. A simpler BAS will be the standard option for all small businesses from 1 July 2017.

Fuel Tax Credits - Six Monthly Indexation Alert
The Buzz

The ATO has just issued a reminder that fuel tax credit rates increase for fuels acquired from this Saturday 1 August 2015. Rates are indexed twice a year, in February and August, in line with the CPI.

When completing each BAS, you should ensure you check the rates at Rates - business as clients may have more than one rate in a BAS period. We would also encourage the use of the ATO’s Fuel tax credit calculator

SuperStream Deadline Extended
The Buzz

For those of you that handle client payroll and superannuation, the ATO has just announced that it has extended the deadline for larger businesses to comply with SuperStream. Employers with 20 or more employees were required to be SuperStream compliant by 1 July 2015. However the ATO has now extended this deadline for employers who are not ready by four months until 31 October 2015. Smaller employers (those with less than 20 employees) have until 30 June 2016 to comply with SuperStream
 
In practical terms, complying with Superstream may mean:

  • Upgrading your payroll software – the latest versions of the main software brands are generally speaking SuperStream compliant
  • Using a commercial superannuation Clearing House or the ATO’s Small Business Clearing House
  • Using the employer’s default superannuation fund (which may have its own compliant facilities).

Advice to Business Owners
Increase to minimum wage starts 1 July 2013!

For those bookkeepers who handle Payroll, it's time to get your clients informed on pay changes! This morning the Fair Work Commission ruled that the 1.5 million Australians who rely on awards or the national minimum wage to set their pay rate will receive a pay rise of around $16 a week.

Key Facts:

  • The national minimum wage will now be $622 a week, or $16.37 per hour.
  • Each year, Australia’s national workplace relations tribunal sets a minimum wage.
  • Australia’s minimum wage, which will remain $606 a week until July 1, represents about $31 500 a year.

Treasury has just released draft legislation which will give the Tax Practitioners Board (TPB) the power to determine the definition of “BAS service”. Currently, the TPB has no such power and needs to lobby Treasury (who has final say) in order to make any changes in this area....

TPB Draft Information Sheet - Cloud Computing - Professional Indemnity Insurance Update

We have received preliminary advice from our professional Indemnity underwriters that if the TPBs Draft Information Sheet – Cloud Computing proceeds in its current form then it could have adverse outcomes. When a statutory authority like the TPB prescribe a wide interpretation on a professional conduct issue (as has been done in the Draft Information Sheet Cloud Computing and the code of professional conduct) then this could expose gaps in cover in existing policies. This risks BAS agent’s cover and potentially may leave some exposed. In addition to the potentially adverse PI aspects this Draft Information Sheet has a number of other consequences that can really only be described as BAS agent unfriendly. While our position has not been well supported by other associations you can rest assured we will continue to lobby for significant amendment to this document.

It’s been a busy couple of months with the BAS simplification ‘fix-it squad’ and also the ramping up of the ‘Reinventing the ATO’ program.

Earlier this year the Hon. Bruce Billson MP (previous Federal Minister for Small Business) instigated a ‘fix-it squad’ to work out how the BAS process could be simplified for small business. There has been extensive consultation with Practitioners, Associations (including Australian Bookkeepers Association) and Small Business all working together on solutions to make our complex GST system a little simpler for reporting purposes. We are yet to see the final results, but as soon as they are released I will report back with what they are and how they impact us as bookkeepers and BAS Agents.

At BASAAG last month we discussed the impact of myGov and Business Activity Statements. As the September quarter BAS is the first quarter to be impacted, many of you may not be aware that if your sole trader clients have signed up to a myGov account their BASs will now be sent directly to their myGov inbox. This is obviously a huge change and impacts us particularly where we were previously getting their BASs. As an interim measure the ATO will be emailing agents advising when their linked clients’ BASs are forwarded to their myGov accounts. To ensure you get this notification it is important that you ensure your ATO client list is up to date. More information about this new system can be found here.

The ATO has also been working hard at improving the search functionality on its website. They have issued a Guide to Smarter Searching which is well worth flicking through to assist you finding information quickly and easily. I have personally found that the ATO search functionality is now better than using Google, so if you haven’t been game to use it for a while, it’s well worth trying now.

There are also lots of changes coming up to Superannuation Guarantee Charge. The 2 major changes are as of 1 July 2016:

1. The nominal interest rates will be calculated on the number of days the superannuation is unpaid (it is currently as of the 1st day of the superannuation quarter that it relates to).

2. SGC will be calculated on the narrower concept of ordinary time earnings (OTE) rather than all salary & wages. (this legislation is currently before parliament)
