Bookkeeper-Client Connect Terms & Conditions

Permitted File Types

Most file types can be transferred using Bookkeeper-Client Connect. However, for everyone’s protection, we block file types that are notoriously malicious (e.g. executables). If you receive a dialog box which blocks your file transfer due to it being an unsupported file type, please contact us to discuss whether the file type in question can be added to our list of acceptable files.

Storage Periods

As Bookkeeper-Client Connect is not designed as a storage facility, but rather as a medium to transfer files, a time limit of 7 days applies to the storage of files which have been transferred. Accordingly, please ensure that back-ups are maintained for all files transferred using Bookkeeper-Client Connect. Do not use Bookkeeper-Client Connect to store the only copy of a file.
 
It is your responsibility to ensure that you have saved to your local computer drive (or other storage media) any files that you wish to retain and also to advise your client to save on their local computer drive (or other storage media) any files that they wish to retain. ABN and its service providers are in no way responsible to any party for removal and deletion of files beyond the 7 day period notified in this clause.
 
The 7 day storage period will not apply if you have purchased additional storage from us, however you will still need to ensure that the additional storage you have purchased adequately caters for the files you are wishing to store.

Acceptable Use - Generally

You may not use Bookkeeper-Client Connect to transmit, distribute or store material that is:

• In violation of any applicable law or regulation;
• In violation of copyright, trademark or other intellectual property rights;
• In violation of privacy rules or personal rights of other; or
• Defamatory, obscene, threatening, abusive or hateful.
 
Before using Bookkeeper-Client Connect to transfer files created using proprietary software, we encourage you to familiarise yourself with any prevailing licensing or copyright laws which may be stipulated by the software vendor.

Acceptable Use –Transfer of MYOB Files

MYOB Australia is committed to assisting Commercial bookkeepers in their business and ensuring best practise for their clients. Australian Bookkeepers Network has worked with MYOB Australia Pty Ltd to ensure that this service meets the License agreement of the MYOB Software. Provided that both the Bookkeeper and the client of the bookkeeper have their own licensed copy of the MYOB software then it is not breaching licensing agreements by using this service.

Acceptable Use – Transfer of Quicken Files

Reckon Ltd is committed to assisting bookkeepers ensure best practice for their business. The Bookkeeper-Client Connect service is independent of Reckon Ltd and its terms of use or licenses do not cover your arrangement with Reckon Ltd. You should ensure that both you and your clients are using software that is not in breach of your licensing agreement with Reckon Ltd.

Privacy

ABN complies with all applicable privacy laws and will not access files stored on, or transferred using, Bookkeeper-Client Connect unless Australian Bookkeepers Network is selected as the file recipient.

Security of Access Information

You are responsible for the safeguarding of the user name and password information which enables your access to Bookkeeper-Client Connect. You are also responsible for the safeguarding of this information should you choose to provide it to staff or any other persons.

Disclaimer

ABN and its service providers do not represent or guarantee the truthfulness, accuracy or reliability of any files transferred using Bookkeeper-Client Connect. ABN acts as a passive conduit for the online distribution and receipt of user information and is under no obligation, and is not responsible for, screening any communications by users. By using Bookkeeper-Client Connect, you acknowledge that ABN is not responsible for virus checking files sent to or by your clients and agree to maintain virus protection software adequate for your needs.
 
ABN has no responsibility for the deletion, corruption, or failure to store any data stored or transmitted by the service. ABN makes no guarantee that the service will be uninterrupted, timely or error free. Any material and/or data obtained through the use of the service is at your own risk and you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material and/or data.
 
If notified of a breach of the terms and conditions of this agreement, ABN or its service providers may investigate the alleged breach and determine at their absolute discretion any removal of content or further action to be taken. Breaches of the use of Bookkeeper-Client Connect may result in termination of this agreement and may further result in legal action by ABN or its service providers.

Bookkeeper-Client Connect – Additional Terms & Conditions Affecting ABN Members

Free Monthly Allowance of Throughput & Storage

ABN’s costs in hosting your Bookkeeper-Client Connect facility are influenced by two things:

1. the amount of data that has been uploaded and downloaded to your facility, both by your firm and your clients. We refer to this as “throughput”.

2. the amount of data that is stored on your facility at any one time. We refer to this as “storage”.
 
ABN members receive a generous free monthly allowance on Bookkeeper-Client Connect of 500 MB of throughput and 250 MB of storage. This will be more than adequate for the vast majority of users.

However, we recognise that some of our members operate larger bookkeeping practices and have made available additional throughput and storage for a nominal price, as detailed in the next section.
 
We recommend that larger files be compressed using a licensed copy of WinZip or similar compression software.

Purchasing Additional Throughput & Storage

You can request additional throughput and storage from within the “Settings” section of your Bookkeeper-Client Connect facility. Additional throughput can be purchased at the rate of $11 per gigabyte (GB) per month. 1 gigabyte equals 1,024 megabytes. Additional storage can be purchased at the rate of $11 per 250 MB per month.

If you request a new throughput or storage level, then following the end of the calendar month in which you requested the change, we will email you a Tax Invoice detailing the charges. Approximately three weeks later, we will direct debit this amount from the bank account or credit card which you nominated in your original
Direct Debit Agreement with us.
 
If you request a new throughput or storage level, it will remain at the selected level and you will continue to be invoiced each month until such time that you choose to alter the level. Please note the following:

• Additional throughput or storage levels expire at the end of each calendar month – unused throughput or storage does not carry forward to later calendar months.
• Charges in relation to additional throughput or storage levels are not pro-rated. For example, if you request an additional 1GB of storage on the 25th of a month, you will be charged $11 for that calendar month.
• Charges in relation to additional throughput or storage limits are based on the highest limit which you have chosen to have in place in a given calendar month. For example, if on the 15th of a month you chose to increase your throughput allowance to 2.5 GB, and then on the 25th of the same month, you chose to decrease your throughput allowance to 1.5 GB, your additional throughput charge for that calendar month will be based on 2.5 GB.

Storage Periods

The 7 day storage period will not apply if you have purchased additional storage from us, however you will still need to ensure that the additional storage you have purchased adequately caters for the files you are wishing to store.

Throughput & Storage Warning Emails

If you reach 80% of your monthly allowance of either throughput or storage, you will receive an email from us. You can then decide whether you would like to purchase additional throughput or storage. Additional throughput or storage levels can be purchased on a month-by-month basis as detailed in the preceding section.
 
If you reach 100% of your monthly allowance of either throughput or storage, you will receive another email from us. In the case of your throughput allowance exhausting, unless you purchase additional throughput, you or your clients will not be able to upload or download any further files to Bookkeeper-Client Connect for the remainder of that calendar month. In the case of your storage allowance exhausting, unless you purchased additional storage or take steps to delete data, you or your clients will not be able to upload or download any further files to Bookkeeper-Client Connect for the remainder of that calendar month.
